Wills and Estate Planning

Your estate is everything that you own on death and making a Will provides family members with peace of mind that your assets are distributed in accordance with your wishes. Making a Will can:

  • Appoint executors and trustees to deal with the estate
  • Include funeral provisions
  • Appoint legal guardians to care for minor children
  • Ensure assets pass to chosen recipients, either individuals or charities
  • Minimise Inheritance Tax
  • Reflect changes in circumstances such as marriage, divorce or birth
  • Set up trusts

Without a valid Will or any Will at all, the law decides who will inherit your estate and will deal with the administration. These are known as “intestacy rules” set out by the Government and will establish how your estate passes. This may not be in the most tax efficient way and there is no guarantee that your chosen individuals will administer your estate, or even inherit.

Our costs start from £350 plus VAT for a single Will and £600 plus VAT for a pair of Wills, depending on the complexity.


LPAs

Lasting Powers of Attorney (LPAs) are legal documents that are designed to protect an individual in the event of losing mental capacity or becoming incapacitated during lifetime.

An LPA appoints trusted people (referred to as attorneys) to look after your affairs and make decisions on your behalf if you are unable to do so yourself. These come in two forms, one dealing with Property and Financial Affairs and the other Health and Welfare. You can complete either or both documents, although the latter is our recommendation.

Everyone, at any adult age, should have LPAs in place as it will provide assurance and assist with important decisions where one may not have the required capacity to do so. Such decisions include:

  • Signing important documents
  • The type of medical care and treatment required
  • Moving into a care home

Our costs start from £350 plus VAT for a single LPA and £600 plus VAT for a pair of LPAs. There are additional registration fees of £82 per document payable to the Office of the Public Guardian.


Estate administration

Losing a loved one is a very emotional time and we would take the utmost care to assist you in a sensitive manner, by phone, email or a face-to-face meeting. We provide guidance at a time when a bereaved person needs it more than ever.

We tailor our services to your needs, either dealing with the entire estate administration or certain aspects. Our Estate Administration services include:

  • Establishing the assets
  • Contacting the relevant providers
  • Paying creditors and beneficiaries
  • Preparing the Inheritance Tax return
  • Applying for the Grant of Representation
  • Advising on and dealing with any trusts
  • Selling or transferring property
  • Collecting and administering assets
  • Dealing with tax formalities
  • Reporting to executors
  • Liaising with beneficiaries
  • Preparing estate accounts

Our costs for assisting with estate administration start from £1,250 plus VAT, depending on the complexity. There is also an additional fee of approximately £300 for the Court fee.
